The actualism/possibilism debate in ethics concerns the relationship between an agent’s free actions and her moral obligations. The actualist affirms, while the possibilist denies, that facts about what agents would freely do in certain circumstances partly determines that agent’s moral obligations. This paper assesses the plausibility of actualism and possibilism in light of desiderata about accounts of blameworthiness. This paper first argues that actualism cannot straightforwardly accommodate certain very plausible desiderata before offering a few independent solutions on behalf of the (...) actualist. It is widely thought that, to be morally responsible for some action or omission, an agent must have had, at the very least, the general ability to do otherwise. As we argue, however, there are counterexamples to the claim that moral responsibility requires the general ability to do otherwise. We present several cases in which agents lack the general ability to do otherwise and yet are intuitively morally responsible for what they do, and we argue that such cases raise problems (...) for various kinds of accounts of moral responsibility. We suggest two alternative approaches to thinking about the connection between moral responsibility and abilities to do otherwise, one of which denies that there is any ability-to-do-otherwise requirement on moral responsibility and the other of which requires only an opportunity to do otherwise. We also argue that a general-ability-to-do-otherwise requirement not only faces counterexamples but also lacks positive motivation. (shrink)

Some philosophers have argued that the paucity of evidence for theism — along with basic assumptions about God's nature — is ipso facto evidence for atheism. The resulting argument has come to be known as the argument from divine hiddenness. Theists have challenged both the major and minor premises of the argument by offering defences. However, all of the major, contemporary defences are failures. What unites these failures is instructive: each is implausible given other commitments shared by everyone in the (...) debate or by theists in particular. Only challenges which are plausible given both common sense and other theistic commitments will undermine the argument from divine hiddenness. Given that such defences universally fail, the best hope for a successful challenge to the argument comes from more general sceptical responses. This sort of response is briefly sketched and defended against four independent objections. (shrink)

The powerful new methods, expansive scope, and accelerated pace of human molecular genetics combine to catapult us into ethically unfamiliar territory. These features lend special urgency to questions of genetic ownership and privacy, disease and normalcy, identity and genetic determinism, and early diagnosis and therapy.

From an ethical point of view, shared decision-making is preferable to either physician paternalism or patient sovereignty. The traditional model of doctor-patient communication is too directive and too unconcerned with the patient's values to support truly shared decision-making. The traditional distinction between rhetoric and sophistic can provide the basis for a new model of mutual persuasion that does not limit communication to information, and that avoids the spectre of manipulation.

Interpreting Figurative Meaning critically evaluates the recent empirical work from psycholinguistics and neuroscience examining the successes and difficulties associated with interpreting figurative language. There is now a huge, often contradictory literature on how people understand figures of speech. Gibbs and Colston argue that there may not be a single theory or model that adequately explains both the processes and products of figurative meaning experience. Experimental research may ultimately be unable to simply adjudicate between current models in psychology, linguistics and philosophy (...) of how figurative meaning is interpreted. Alternatively, the authors advance a broad theoretical framework, motivated by ideas from 'dynamical systems theory', that describes the multiple, interacting influences which shape people's experiences of figurative meaning in discourse. Ordinarily, we take moral responsibility to come in degrees. Despite this commonplace, theories of moral responsibility have focused on the minimum threshold conditions under which agents are morally responsible. But this cannot account for our practices of holding agents to be more or less responsible. In this paper we remedy this omission. More specifically, we extend an account of reasons-responsiveness due to John Martin Fischer and Mark Ravizza according to which an agent is morally responsible only if she is appropriately (...) receptive to and reactive to reasons for action. Building on this, we claim that the degree to which an agent is responsible will depend on the degree to which she is able to recognize and react to reasons. To analyze this, we appeal to relations of comparative similarity between possible worlds, arguing that the degree to which an agent is reasons-reactive depends on the nearest possible world in which given sufficient reason to do otherwise, she does so. Similarly, we argue that the degree to which an agent is reasons-receptive will depend on the intelligibility of her patterned recognition of reasons. By extending an account of reasons-responsiveness in these ways, we are able to rationalize our practice of judging people to be more or less responsible. (shrink)

Expressions of the form 'S is aware of the fact that p' are commonplace. This book provides a systematic exploration of the relation between knowledge and factual awareness, arguing that knowledge is but one species of factual awareness and that we can understand the possession of objective reasons, the normativity of knowledge, and the nature of knowledge in terms of factual awareness. In this way, the state of factual awareness is, structurally and substantively, a more basic type of state than (...) knowledge. If correct, this undermines a number of ways in which knowledge has been regarded as ‘first’ in recent epistemology. (shrink)

In the debates surrounding the Patient Protection and Affordable Care Act, little attention has been paid to definitions of important terms like "health care," "disease," and "disorder." When health care is discussed, one assumes universal definitions of terms and a common understanding of their meanings. But delving deeper into the subject, one finds that a common understanding is lacking. Specifically, the liberal tradition, from which the health care act was derived, defines important health care terms in ways that most people (...) would not. This paper applies Alasdair MacIntyre's discussion of tradition-based rational enquiry to show that proper definitions of "health care," "disease," and "disorder" should be based on the normal functioning of the organs and organ systems of the human body. Many philosophers maintain that the ability to do otherwise is compatible with comprehensive divine foreknowledge but incompatible with the truth of causal determinism. But the Fixity of the Past principle underlying the rejection of compatibilism about the ability to do otherwise and determinism appears to generate an argument also for the incompatibility of the ability to do otherwise and divine foreknowledge. By developing an account of ability that appeals to the notion of explanatory dependence, we can replace the Fixity of (...) the Past with a principle that does not generate this difficulty. I develop such an account and defend it from objections. I also explore some of the account's implications, including whether the account is consistent with presentism. (shrink)

ABSTRACT Many of our common-sense moral judgments seemingly imply the existence of moral luck. I attempt to avoid moral luck while retaining most of these judgments. I defend a view on which agents have moral equality of opportunity. This allows us to account for our anti-moral-luck intuitions at less cost than has been previously recognized.

The philosophical implication that guides the issue addressed here is the following: how does the principle of the common constitute a frontal apophasis to the principle of property in contemporary democracies? I do not pretend to offer an exhaustive answer to this problem. However, I use the argumentative strategy of dividing this paper into three sections: (i) theoretically investigate the dialectical tension between the principle of the common and the principle of property; (ii) analytically observe the premise that the behavioral (...) practices of exacerbated individualism contribute as an act of aversion to the principle of the common and (iii) dwell on the articulation of the notion of the principle of the common as a factor that is present on the threshold between the philosophical vulgar and philosophical universal. Finally, I form some considerations that problematize the naturalized notion of the principle of property in current democracies, in view of the constituent power that the principle of the common holds in the perspective of achieving the well-being of human agents in contemporary community life. This essay is a defense of the social construction of racialism. I follow a standard definition of “racialism” which is the belief that “there are heritable characteristics, possessed by members of our species, that allow us to divide them into a small set of races, in such a way that all the members of these races share certain traits and tendencies with each other that they do not share with other members of any other race”. In particular I want to (...) defend the “radical” social-constructive thesis that holds “the concept of race is exclusively the product of historical and cultural causes. It claims that humans do not tend to classify people into races when groups with different phenotypes meet, save for particular historical circumstances”. The quoted position is the consensus view among historians, sociologists, anthropologists, and other social scientists who study racialism but has recently been criticized by philosophical defenders of cognitive/evolutionary psychological approaches to racialism. Drawing on developmental studies as well as historical and contemporary cross-cultural research, CEP philosophers point to similarities of racialism across time and space. They hold that social constructionist approaches to racialism cannot explain these similarities. I hold that SC approaches do explain these similarities and that such similarities actually pose a significant challenge to the proposed CEP research program on racialism. (shrink)

Frankfurt cases are supposed to provide us with counterexamples to the principle of alternative possibilities. Among the most well known responses to these cases is what John Fischer has dubbed the flicker of freedom strategy. Here we revisit a version of this strategy, which we refer to as the fine-grained response. Although a number of philosophers, including some who are otherwise unsympathetic to Frankfurt’s argument, have dismissed the fine grained response, we believe there is a good deal to be said (...) on its behalf. We argue, in particular, that reflection on certain cases involving omissions undermines the main objections to the response and also provides the groundwork for an argument in support of it. This paper has two goals: (1) to defend a particular response to the problem of resultant moral luck and (2) to defend the claim that we are only responsible for what we could have avoided. Cases of overdetermination threaten to undermine the claim that we are only responsible for what we could have avoided. To deal with this issue, I will motivate a particular way of responding to the problem of resultant moral luck. I defend the view that one's degree (...) of responsibility is immune to moral luck but the scope of events for which one is responsible is subject to moral luck. I will then argue that this view allows us to explain away certain intuitions about responsibility and overdetermination (as well as similar intuitions regarding Frankfurt Cases). As a result, the claim that we are only responsible for what we could have avoided becomes significantly more plausible. (shrink)
